XL Specialty Settles Jackpine Lumber Export Fee Suit

Law360, New York (September 15, 2010, 12:55 PM EDT) -- The U.S. Court of International Trade on Wednesday dismissed a four-year-old Customs and Border Protection suit against now-bankrupt Jackpine Forest Products Ltd. and XL Specialty Insurance Co., after the insurer agreed to pay more than $131,000 to settle claims the Canadian lumber company failed to pay proper export fees.

A clerk's dismissal was docketed after CIT Judge Richard K. Eaton issued an order Sept. 7 to end the proceedings when the insurer made payment as part of a settlement reached in August.
