Law360 (February 27, 2007, 12:00 AM EST) -- The long-standing battle between laser eye surgery rivals Synergetics USA Inc. and Iridex Corp. gained speed Tuesday when a federal judge ruled that an older version of Synergetics’ laser connector infringed on 12 separate claims of Iridex’s laser patent.
Ruling on both companies’ motions for summary judgment, U.S District Court Judge Catherine D. Perry said while Synergetics’ older product infringed on 12 out of 19 of the claims in Iridex’s patent, the new version of the product, launched after the lawsuit was filed, does not infringe. Therefore, she granted partial summary judgment to both parties.
