FirstHealth's Trademark Challenge Founders

Law360 (March 1, 2007, 12:00 AM EST) -- A federal appeals court has affirmed a decision by the U.S. trademark authority to reject a health care company’s attempt to invalidate the name of a Blue Cross Blue Shield affiliate in order to prevent confusion.

The ruling, issued Feb. 27 by the U.S. Court of Appeals for the Federal Circuit, was a setback for FirstHealth of the Carolinas Inc., a hospital operator that challenged trademarks held by Owings Mills, Md.-based CareFirst Inc.
