Massey Challenge Of MSHA In Blast Probe Dismissed

Law360, New York (September 22, 2010, 5:54 PM EDT) -- A federal judge has denied Massey Energy Co. the power to take photographs and gather its own physical evidence at its destroyed Upper Big Branch Mine, finding the government's handling of the investigation into the fatal mine explosion to be enough.

Margaret A. Miller, an administrative law judge with the Federal Mine Safety and Health Review Commission, granted summary judgment to the U.S. government on Friday in a case over how to conduct the probe of the mine, where an explosion in April killed 29 miners....
