US Urges NAFTA To Take Mexican Tuna Spat

Law360, New York (September 24, 2010, 6:47 PM EDT) -- The U.S. has asked the North American Free Trade Agreement's Free Trade Commission to establish a settlement panel to resolve a dispute over the proper forum for Mexico's complaint about American laws on “dolphin safe” tuna labels.

Mexico filed a complaint with the World Trade Organization over the law in March 2009, but the U.S. maintains that the dispute must be heard by NAFTA under the provisions of the trade agreement. Mexico has to date refused to move the case out of the WTO.
