Plaintiffs Regroup, Hit Tyson With Smaller FLSA Suit

Law360, New York (March 2, 2007, 12:00 AM EST) -- Three women who had their claims dismissed without prejudice after a federal judge refused to allow a nationwide collective action against Tyson Foods Inc. to go forward have filed a lawsuit in their home state of Oklahoma accusing Tyson of violating the Fair Labor Standards Act.

An Alabama judge issued an order dismissing the plaintiffs’ claims without prejudice in December 2006, but the effective date of the dismissal was March 1, 2007. Thursday, the plaintiffs filed a proposed collective action in Oklahoma, claiming that Tyson failed...
