Scalia Extends Stay Of $270M Big Tobacco Judgment

Law360, New York (September 27, 2010, 3:50 PM EDT) -- U.S. Supreme Court Justice Antonin Scalia has extended a Louisiana court's stay on a mandate that tobacco giants including Philip Morris USA pay $270 million to fund a smoking cessation program, citing a significant possibility that the high court will reverse the award.

Justice Scalia ruled Friday that the judgment should be stayed until the high court can act on the tobacco companies' petition for certiorari because Louisiana’s Fourth Circuit Court of Appeal may have violated their due process rights.
