Sanofi Taxotere Patents Ruled Invalid In Hospira Spat

Law360, New York (September 28, 2010, 2:07 PM EDT) -- A federal judge has invalidated two patents for Sanofi-Aventis SA's flagship cancer treatment Taxotere, paving the way for rival Hospira Inc. to bring a generic version of the drug to the market.

Judge Gregory Sleet of the U.S. District Court for the District of Delaware ruled Monday that the defendants had established by “clear and convincing evidence” that the French drug giant's patents were invalid due to obviousness and unenforceable due to inequitable conduct.
