National Union Ditches Bad Faith Claim In DSW Spat

Law360, New York (September 30, 2010, 3:44 PM EDT) -- An American International Group Inc. unit is off the hook for the bad faith claim in DSW Shoe Warehouse Inc.'s suit seeking coverage for losses stemming from the theft of 1.4 million DSW customers' personal financial data.

Judge Michael H. Watson granted the insurer's renewed motion for summary judgment on DSW's bad faith claim in the U.S. District Court for the Southern District of Ohio on Tuesday, ruling that DSW and Retail Ventures Inc., its parent company, are not entitled to punitive damages.
