5th Circ. Moots Drilling Ban Challenge

Law360, New York (September 30, 2010, 7:54 PM EDT) -- An appeals court has tossed an oil-industry challenge to the Obama administration’s six-month ban on deepwater drilling, saying the challenge applies only to the first version of the ban and not the one currently in place.

Because the first injunction was rescinded by Secretary of the Interior Ken Salazar, any court opinion on the merits and legality of its issuance would be moot, according to the 2-1 opinion issued Wednesday by the U.S. Court of Appeals for the Fifth Circuit.
