Roche Suit Over Diabetes Test Strips Crumbles

Law360, New York (March 5, 2007, 12:00 AM EST) -- Swiss drug maker Roche Holdings Ltd.'s patent infringement lawsuit over diabetes-test devices has effectively unraveled after a summary judgment ruling in favor of U.S. rival Home Diagnostics Inc.

The order, issued March 2 in federal court for the Southern District of Indiana, also denied a summary judgment motion filed by Roche's diagnostics division, Indianapolis, Ind.-based Roche Diagnostics Corp.

For the time being, Judge Larry McKinney’s ruling clears Home Diagnostics’ testing products for diabetics, including its TrueTrack Smart System and TrackEase Smart System.
