3rd Circ. Says Ledbetter Won't Cover Promotion Claims

Law360, New York (October 1, 2010, 7:06 PM EDT) -- A federal appeals court has ruled that the recently enacted Lilly Ledbetter Fair Pay Act does not apply to discrimination claims tied to an employer's alleged failure to promote a particular worker.

Handing a victory to The Boeing Co. the U.S. Court of Appeals for the Third Circuit said in a ruling handed down Friday that the Lilly Ledbetter Fair Pay Act cannot apply to so-called failure-to-promote claims, rather only to claims that a particular wage payment was made in a discriminatory fashion.
