All Tools Fails In Challenge To Twice-Applied Duty

Law360, New York (October 6, 2010, 2:30 PM EDT) -- All Tools Inc. missed a statutory deadline to challenge a doubled-up anti-dumping duty on paint brushes imported from China, a federal judge has ruled, throwing out the importer's suit over a 704 percent markup assessed in 2004 by U.S. Customs and Border Protection.

All Tools "did not act in a diligent fashion to commence its suit,” Judge Richard K. Eaton ruled Tuesday in the U.S. Court of International Trade, granting summary judgment to the government.
