W.Va. Fights EPA's New Curbs On Mountaintop Mining

Law360, New York (October 7, 2010, 1:26 PM EDT) -- West Virginia has sued the U.S. Environmental Protection Agency to overturn recently beefed-up environmental requirements for mountaintop coal mining in Appalachia, contending the EPA has robbed the state of its authority to police water quality.

Gov. Joe Manchin, a Democrat who's vying for the late Sen. Robert Byrd's seat, held a press conference Wednesday announcing the filing of the Clean Water Act and Administrative Procedure Act suit in the U.S. District Court for the Southern District of West Virginia.
