American Apparel Fired Cancer-Stricken Worker: EEOC

Law360, New York (October 6, 2010, 3:48 PM EDT) -- American Apparel Inc. violated federal law when it terminated a disabled garment worker while he was on medical leave for cancer treatment, the U.S. Equal Employment Opportunity Commission has claimed in a suit against the retailer.

The garment worker, Jose De Los Santos, requested medical leave in order to undergo chemotherapy treatment for metastatic testicular cancer and the request was granted, the EEOC said in its suit lodged Sept. 29 in the U.S. District Court for the District of Los Angeles.
