Shah Bros. Loses Gutkha Import Classification Case

Law360, New York (October 7, 2010, 5:54 PM EDT) -- A federal judge has tossed out a lawsuit filed by an importer of gutkha, a chewable intoxicant from India, that wanted the U.S. government to reclassify its goods, ruling that the court had no authority over the matter.

The importer, Shah Bros. Inc., had not established that the protest procedures U.S. Customs and Border Protection provided were inadequate to address its needs, Judge Donald C. Pogue of the U.S. Court of International Trade said Wednesday.
