Massey Unit Accuses US Of FOIA Violations In Probe

Law360, New York (October 7, 2010, 3:17 PM EDT) -- Massey Energy Co. unit Performance Coal Co. has sued the U.S. government in an effort to speed up action on Freedom of Information Act requests the company submitted in the wake of an April explosion at its Upper Big Branch mine that killed 29 workers.

The coal company retained Allen Guthrie & Thomas PLLC to file the FOIA requests in May and June in its ongoing investigation of the accident, according to a complaint filed Tuesday in the U.S. District Court for the District of Columbia....
