Court Sides With Union In Bargaining Agreement Spat

Law360 (March 7, 2007, 12:00 AM EST) -- A company that split from Shell Oil Co. but kept its workers union’s collective bargaining agreement was wrong to hire subcontractors instead of union members after the changeover, an appeals court decided on Tuesday.

Resolution Performance Products LLC should have continued Shell’s tradition of hiring member workers for maintenance work, the Fifth Circuit said in its ruling.
