Pollution Suit Against RRI Energy Stays Alive

Law360, New York (October 12, 2010, 5:07 PM EDT) -- Two environmental groups have managed to resurrect their once-dead lawsuit alleging RRI Energy Inc. discharged pollutants from a coal-fired power plant into Pennsylvania's Conemaugh River.

Magistrate Judge Amy Reynolds Hay of the U.S. District Court for the Western District of Pennsylvania rejected RRI's entire motion to dismiss on Friday, ruling that an agreement the company entered into with Pennsylvania's environmental agency did not bar the groups from bringing a citizen suit under the federal Clean Water Act.
