7th Circ. Reverses CAA Verdict Against Duke Unit

Law360, New York (October 12, 2010, 7:18 PM EDT) -- A Duke Energy Corp. unit on Tuesday won the reversal of a jury verdict that found the company had violated the Clean Air Act by making modifications to a coal-fired electric power plant in Indiana without obtaining a permit.

The U.S. Court of Appeals for the Seventh Circuit overturned a jury's finding that renovations to Cinergy Corp.'s plant in Wabash, Indiana, undertaken between 1989 and 1992 were likely to increase the plant’s annual emissions of sulfur dioxide and nitrogen oxide, and therefore the company should have...
