3rd Circ. Puts Out Coverage Claim In Tobacco Ad Spat

Law360, New York (October 12, 2010, 5:36 PM EDT) -- A federal appeals court on Tuesday upheld a ruling that National Union Fire Insurance Co. of Pittsburgh, Pa., is not liable for the American Legacy Foundation's $17 million bill in underlying contract litigation over the group's anti-smoking ads.

The U.S Court of Appeals for the Third Circuit said the foundation's delay in notifying National Union of the potential claim proved fatal to its case. It also determined that the insurance policies at issue excluded the claims in the underlying litigation.
