Invalidity Ruling For Solvay Chemical Patent Reversed

Law360, New York (October 14, 2010, 12:49 PM EDT) -- The U.S. Court of Appeals for the Federal Circuit has reversed a lower court's decision that invalidated a patent held by Solvay SA on methods for making a chemical used in refrigeration, reviving Solvay's infringement case against Honeywell International Inc.

The appeals court on Wednesday found that, contrary to a 2008 ruling by Judge Sue L. Robinson of the U.S. District Court for the District of Delaware, Honeywell is not a prior inventor of the technology involved in Solvay's patent, and the patent is therefore valid....
