Fed. Circ. Sides With Gilda In Spat Over US Duties

Law360, New York (October 13, 2010, 4:40 PM EDT) -- A federal appeals court declined Wednesday to reinstate retaliatory trade sanctions against toasted-bread importer Gilda Industries Inc., shooting down the federal government's attempt to argue its way out of a snafu that let the duties expire.

A three-judge panel of the U.S. Court of Appeals for the Federal Circuit upheld a lower court decision to read the relevant trade law strictly — if no U.S. producers make a formal request to keep trade sanctions by the deadline, then they end, the panel said.
