EPA Seeks Veto Of Arch's W.Va. Coal Mine Permit

Law360, New York (October 18, 2010, 4:57 PM EDT) -- The U.S. Environmental Protection Agency is seeking the withdrawal of an Arch Coal Inc. unit's mining permit for a West Virginia mountaintop site — the agency's first-ever veto recommendation on a valid Clean Water Act permit — saying the project would destroy wildlife and degrade aquatic ecosystems.

The recommendation was made by EPA Region III Administrator Shawn Garvin on Sept. 24 but released publicly Friday, the latest step in the agency's yearlong effort to nix the permit.
