House Bill Aims To Halt Spike In False Marking Suits

Law360, New York (October 15, 2010, 6:59 PM EDT) -- A recently introduced bill to amend Section 292 of the Patent Act to bar the interpretation that false marking should be punished by a fine for each product on the market is likely to quell the recent explosion of false marking claims, lawyers said Friday.

Although Rep. Bob Latta, R-Ohio, introduced the bill, H.R. 6352, the Patent Lawsuit Reform Act of 2010, on Sept. 29, the full text of the legislation only recently became available so lawyers could read it and weigh in.
