Hot-Sauce Maker Hits Publix With Antitrust Suit

Law360, New York (October 18, 2010, 4:35 PM EDT) -- The owner of a condiments business has sued two food distribution companies and Publix Super Markets Inc., alleging they conspired to keep her hot sauces and other products off the shelves of the Southeast grocery store chain.

Patricia A. Cunningham, who operates Cunningham's Memphis Gourmet Sauce, lodged a compliant Thursday in the U.S. District Court for the Middle District of Florida, alleging Publix, Seidman Hudon Food Brokerage Co. and food distributor Tree of Life violated the Sherman Act, Clayton Act and state antitrust laws.
