Coal Group Sues EPA Over Mountaintop Mining Rules

Law360, New York (October 18, 2010, 5:08 PM EDT) -- The Kentucky Coal Association has sued the U.S. Environmental Protection Agency over recently introduced permitting requirements for mountaintop mining, which the trade group claims are based on faulty science.

The case, filed Monday in the U.S. District Court for the Eastern District of Kentucky, alleges that the EPA's rules, announced in April, are arbitrary and capricious and violate the Administrative Procedure Act and the Clean Water Act.
