Nucor Loses Subsidy Suit Over Manipulated Yuan

Law360, New York (October 25, 2010, 4:43 PM EDT) -- The U.S. Court of International Trade has dismissed a lawsuit filed by Nucor Corp. challenging the U.S. Department of Commerce’s refusal to investigate a claim that China’s currency manipulation necessitates countervailing duties on the country's exported metal fasteners.

The court ruled Friday that Nucor's challenge was not ripe for review because Commerce's investigation ended before it could issue a reviewable decision.

Commerce had planned to finish its investigation into whether China’s currency manipulation constituted a countervailable subsidy and issue a final decision, but it never did....
