Law360, New York (October 27, 2010, 4:39 PM EDT) -- A federal judge on Wednesday dismissed a suit against Tennessee Commerce Bank that had gone to an appeals court over the question of whether the U.S. Department of Labor could force the bank to rehire a former chief financial officer who made whistleblower allegations under the Sarbanes-Oxley Act.
Judge Aleta A. Trauger of the U.S. District Court for the Middle District of Tennessee agreed to dismiss the suit at the request of both parties.
