US Ordered To Revisit BHP Mining Permit In NM

Law360, New York (November 1, 2010, 4:10 PM EDT) -- A federal judge has ordered U.S. Department of the Interior officials to reconsider a permit issued in 2005 to BHP Navajo Coal Co. for the expansion of a coal mining operation on Navajo lands in New Mexico.

Judge John L. Kane of the U.S. District Court for the District of Colorado ruled Thursday that the DOI's Office of Surface Mining Reclamation and Enforcement violated the National Environmental Policy Act in issuing the permit.
