Only Disabled Can Sue Under ADA Subsection: 6th Circ.

Law360, New York (November 3, 2010, 4:58 PM EDT) -- A federal appeals court on Wednesday ruled that only disabled individuals can pursue claims under Section 12112(b)(6) of the Americans With Disabilities Act, reversing a judgment in favor of a group of former Dura Automotive Systems Inc. employees.

The U.S. Court of Appeals for the Sixth Circuit concluded that although nondisabled individuals could bring claims under some provisions of the ADA, Section 12112(b)(6) covers only individuals with disabilities.
