Court Upholds FDA Ban On Diet Pills

Law360, New York (March 19, 2007, 12:00 AM EDT) -- A federal court has denied a demand by health food maker Nutraceutical Corp to lift the U.S. drug agency’s blanket ban on its dietary supplements.

The Utah federal court granted summary judgment to the Food and Drug Administration, dismissing accusations the agency acted in an “arbitrary and capricious” manner.

The company had asked the court to enjoin the FDA from enforcing a rule making it illegal to sell ephedrinealkaloid dietary supplements (EDS) in the U.S.
