5th Circ. Sides With Insurer In $1.2M Oil Leak Battle

Law360, New York (November 10, 2010, 2:24 PM EST) -- A federal appeals court has upheld a lower court's decision that Aspen Insurance UK Ltd. does not have to reimburse Dune Energy Inc. for a $1.2 million cleanup following a leak at an oil field in Louisiana.

The U.S. Court of Appeals for the Fifth Circuit issued its unpublished opinion Monday. The leak at the Bateman Lake Oil Field was caused by the failure of a flowline operated by Dune and resulted in the spill of 146 barrels of oil. Dune does not own the property,...
