Interest Group Has No Standing In Medicare Suit

Law360, New York (March 20, 2007, 12:00 AM EDT) -- A court has denied a preliminary injunction sought by a public interest law firm against the enforcing of bans on health care providers promoting one Medicare plan over another, ruling the organization has no standing to sue.

The Washington Legal Foundation (WLF) claims the U.S. Department of Health and Human Services and its Centers for Medicare and Medicare Services (CMS) division were violating beneficiaries’ first amendment rights by restricting commercial marketing of the Medicare Prescription Drug Benefit (Medicare Part D).
