Fla. Court Tosses Part Of Chinese Drywall Suit

Law360, New York (November 11, 2010, 7:02 PM EST) -- A Florida judge has trimmed a product liability suit against homebuilders who installed allegedly faulty Chinese drywall in houses, ruling that the economic loss rule bars some of their claims.

Judge Glenn D. Kelley of the Circuit Court for the 15th Judicial Circuit also threw out strict liability and private nuisance claims against Centerline Homes Inc. and other builders that were sued over problems caused by defective Chinese drywall. The decision, issued last Friday, was made public Wednesday.
