Bally Fitness Hit With Wage-And-Hour Suit

Law360, New York (March 20, 2007, 12:00 AM EDT) -- Bally Total Fitness Corp. has been hit with a proposed collective action suit alleging the company did not pay federally mandated overtime rates.

According to the complaint, filed Friday in the U.S. District Court in West Palm Beach, Fla., Bally did not pay time-and-a-half to its employees that worked over 40 hours a week, and also failed to maintain proper time records.

“Defendant’s actions were willful and/or showed reckless disregard for the provisions of the [Fair Labor Standards Act],” the complaint said.
