DOJ Blasts Terra Exec's Spoliation Claim In FCPA Suit

Law360, New York (November 16, 2010, 3:21 PM EST) -- Prosecutors have fired back at a former Terra Telecommunications Corp. president's bid to have the Foreign Corrupt Practices Act case against him tossed because of the destruction of documents in the course of the company's bankruptcy.

Prosecutors filed a response Monday in the U.S. District Court for the Southern District of Florida urging the court to reject Joel Esquenazi's renewed motion to dismiss for spoliation of evidence because the government had no hand in the destruction of Terra's records.
