Lilly Chemotherapy Drug Patent Valid, Judge Rules

Law360, New York (November 16, 2010, 4:26 PM EST) -- A federal judge has upheld the validity of an Eli Lilly & Co. patent challenged by two generics makers that want to launch their own versions of chemotherapy drug Alimta.

Judge Gregory M. Sleet of the U.S. District Court for the District of Delaware issued a bench ruling Monday in favor of the trustees of Princeton University, which owns the patent-in-suit, and Lilly, which holds an exclusive license.
