Attorney Suspended Over Conduct In Black Lung Case

Law360, New York (November 18, 2010, 5:04 PM EST) -- West Virginia's highest court has suspended a Jackson Kelly PLLC attorney for one year after he withheld medical examination records from a pro se claimant during a black lung case.

The attorney, Douglas A. Smoot, must also complete 24 hours of continuing legal eduction and pay for the costs of the disciplinary proceeding, according to an opinion filed Wednesday by the Supreme Court of Appeals of West Virginia.
