Evanston Seeks To Avoid Covering Atty's Fraud Defense

Law360, New York (November 18, 2010, 7:26 PM EST) -- Evanston Insurance Co. is claiming it has no duty to indemnify a St. Louis attorney in two underlying lawsuits involving now-defunct insurers allegedly part of a $1 billion fraud, citing releases and claims in earlier litigation.

Evanston argues that it isn't obligated to indemnify Howard A. Wittner of Wittner Spewak & Maylack PC in two lawsuits, according to a complaint filed Wednesday in the U.S. District Court for the Eastern District of Missouri.
