W.Va. High Court Nixes $4.5M Verdict Against J&J Unit

Law360, New York (November 19, 2010, 6:15 PM EST) -- West Virginia’s Supreme Court has overturned a lower court’s $4.5 million verdict against a division of drugmaker Johnson & Johnson in a false marketing suit launched by the state’s attorney general, and remanded the case to the lower court.

The Circuit Court of Brooke County, W.Va., found on summary judgment in 2008 that Janssen Pharmaceutical Products LP, a Johnson & Johnson division, lied to doctors as a matter of law about the potential side effects of two of its drugs.
