Injured Worker Petitions High Court On FMLA Notices

Law360, New York (November 30, 2010, 6:32 PM EST) -- An employee of Kansas City Freightliner Sales Inc. has petitioned the U.S. Supreme Court to decide on the standard of notice an employee must provide to an employer to gain leave under the Family and Medical Leave Act, a question that currently faces a circuit split as to whether the standard should favor the employer or the employee.
