Lawsuit Forces EPA Action On Kentucky Water Policy

Law360, New York (December 6, 2010, 8:30 PM EST) -- A lawsuit brought by three Kentucky environmental groups has forced the U.S. Environmental  Protection Agency to act on the commonwealth's proposed rules for implementing the Clean Water Act, causing the federal agency to issue a ruling that requires Kentucky to cap the number of exemptions from formal environmental impact reviews granted to small-scale discharges into waterways.
