CFTC Loses Bid For Quick Win In Capital Blu Fraud Suit

Law360 (December 7, 2010, 3:36 PM EST) -- A federal judge has denied the U.S. Commodity Futures Trading Commission's bid for summary judgment in a suit accusing Capital Blu Management LLC and its executives of operating a fraudulent $17 million commodity pool.

Judge John Antoon II of the U.S. District Court for the Middle District of Florida ruled Monday that issues of fact remained on the CFTC's claims, saying that the agency's evidence did not meet the high standard required for summary judgment.
