10th Circ. Won't Revisit Irrigation Co.'s Pollution Suit

Law360, New York (December 14, 2010, 5:02 PM EST) -- A federal appeals court has refused to rehear New Salida Ditch Co.'s lawsuit seeking to force United Fire & Casualty Insurance Co. to cover legal costs the irrigation company incurred after spilling dirt into the Arkansas River in Colorado.

New Salida had petitioned for a panel or en banc rehearing with the U.S. Court of Appeals for the Tenth Circuit in November, but on Monday the court rejected its request.
