6th Circ. Tosses Challenge To Boone Forest Plan

Law360, New York (December 15, 2010, 1:50 PM EST) -- Conservation group Heartwood Inc. does not have standing to challenge the U.S. Forest Service's 2004 decision to allow logging and herbicide use in the Daniel Boone National Forest in eastern Kentucky, a federal appeals court has ruled.

The U.S. Court of Appeals for the Sixth Circuit issued an order Monday reversing a ruling for the U.S. Forest Service and remanding the case to the district court with instructions to dismiss it for lack of jurisdiction.
