India Requires Employers To Pay Tax On Employee Stock Options

Law360 (March 28, 2007, 12:00 AM EDT) -- India recently announced its 2007-2008 budget, effective as of April 1, 2007, which contains several proposed revisions to India's tax laws. Most noteworthy is a proposal to assess a "fringe benefits tax" (FBT) on employers for stock options granted to employees in India.

The FBT will be imposed upon the exercise of stock options by such employees and payable on the difference, if any, between the fair market value of the shares on the date of exercise and the exercise price.
