8th Circ. Affirms Insurer's Win In Payroll Theft Suit

Law360, New York (December 20, 2010, 4:10 PM EST) -- A federal appeals court has denied coffee services company R&J Enterprizes' efforts to force insurer General Casualty Co. of Wisconsin to cover more than $100,000 it lost because of an employee time card scam.

In a published opinion issued Thursday, the U.S. Court of Appeals for the Eighth Circuit upheld a lower court's ruling in favor of General Casualty that a so-called employee dishonesty provision in the commercial marketplace policy at issue doesn't include losses related to hourly wages.
