National Union, Ace Fight $27M Flood Insurance Appeal

Law360, New York (December 20, 2010, 3:52 PM EST) -- National Union Fire Insurance Co. of Pittsburgh, Pa., and Ace American Insurance Co. are pushing back in Penford Corp.'s appeal of a $26.5 million lawsuit alleging the insurers failed to pay out flood damage claims.

The insurers, who filed their brief in the U.S. Court of Appeals for the Eighth Circuit on Friday, claimed Penford wrongly argued that part of the district court’s decision — which labeled relevant clauses of the policy as ambiguous — was final.
