6th Circ. Revives Tenn. Patrolman's Bias Suit

Law360, New York (December 20, 2010, 8:02 PM EST) -- A federal appeals court on Monday revived a lawsuit brought by a highway patrolman who alleged his superiors at the Tennessee Department of Transportation violated his First Amendment rights when they demoted him for supporting Republican political candidates.

In reversing the decision of the U.S. District Court for the Middle District of Tennessee, the U.S. Court of Appeals for the Sixth Circuit said the lower court did not address the fact that a judge at the Tennessee Civil Service Commission found the demotion was entirely unjustified....
